Tents outside the boundary of Mina

govt is putting some tents outside boundary of mina, in Muzdalfa. Saudi Alims
gave fatwa that this space should be considered in Mina also and called it mina
extension
Nowadays due to lot of people the
Saudi govt is also putting some tents outside the boundary of mina and these
tents are located in Muzdalfa. Saudi Alams has given fatwa that due to lack of
space this space should be considered in Mina also and they called it mina
extension. When we paid for a haj package we did not know about this thing. Any
how on first day (8 Dhul Hija) we spend night in our tents i.e. in Mazdalfa. Is
this action OK. 2) After spending the daytime in Arafat (9th Dhul Hijja) and
while returning back to our tents we stopped in Mazdalfa Ground until 1230 night
because we were with our families and after 1230 night we started for our tents.
On reaching the tents we took our beds outside of tents and sleep outside with
our families on the ground as our tents were in Mazdalfa. We slept outside until
some time before Fajr prayer due to cold weather. Is this OK. 3) Next day i.e.
10th Dhul Hijja I went for Rami (stoning). Due to crowd I took also stones for
my wife. After finishing my rami I also throw stones for my wife. Is this action
ok that my wife did not stone herself and he gave her stones to me. 4) After
Tawaf Ifada we spend all nights in our tents (i.e. located in Mazdalfa and said
to be mina extension) and we did not went to mina except for Rami. Is this OK.
A:) 1. The performing of 5 Salaats in Mina (Dhuhr, Asr, Maghrib, Esha and Fajr)
and spending the night between the 8th and 9th of Dhul Hijjah is Sunnah. If a
person did not do so, he will be going against the sunnah. However, no penalty
will be necessary. (al-Manaasik of Mulla Ali Qari pg.188; Fataawa Mahmoodiyah
vol.17 pg.194)
2. Spending the night preceding 10th of Dhul Hijjah in the demarcated area of
Muzdalifah is sunnah and according to some Ulama like Imaam Ahmad, it is Waajib
whether in your tent or outside. However, it is Waajib to be in Muzdlifah from
between Fajr and sunrise on the 10th of DhulHijjah. (Noorul Iedhaah pg.166). If
you did not stay in Muzdalifah between the above mentioned times, then a Damm
will become Waajib on you. (Noorul iedhaah pg.186)
3. Each person has to do ramy for himself. A person cannot do ramy on behalf of
another, except when that person is unable to do ramy. (al-Manaasik pg.247).
Damm will become Waajib on that person who did not do ramy inspite of being able
to do so. (Ibid pg.358)
4. It is Sunnah Muakkadah to spend the night in Mina in the nights of 11th, 12th
and 13th. (al-Manaasik pg.74). However, nothing will become Waajib if a person
did not do so, but his action will not be praiseworthy. (Ibid pg.75)
5. If a person is unable to do ramy due to sickness, etc. he can give his stones
to someone else to throw , there will be no penalty on him. If he is able to do
ramy and still gives stones to someone else, then Damm will become Waajib. (Ibid
pg.247)
6. The Sunnah time for ramy on 11th and 12th is from midday until sunset. To do
ramy after sunset until Fajr time is valid but Makrooh. The sunnah time for ramy
on the 13th is from midday until sunset and to do so after sunset is not
permissible. Note: To do ramy on the 13th from sunrise until midday is valid but
Makrooh.
7. If you covered your head for the entire night, then Damm will become Waajib
and if it was for less than a complete night then Sadaqah will become waajib.
